| The issue of migrant workers is a long-term and complex problem, it is accompanied by China's industrialization, urbanization and modernization. It plays a decisive role in building our country. It is a key element in the building of a harmonious society and the building of comprehensive well-off society, only do the work of migrant workers in order to speed up the realization of our harmonious socialist society and comprehensive process of building our well-off society. The problem of employment of migrant workers is one of the most concern by them, and it is a basic right for them to enjoy other legitimate rights and benefits. In order to better ensure that they enjoy the other rights we can only to guarantee migrant workers the right to employment of migrant workers. We must establish and improve the legal system to protect their legitimate rights and benefits better. We can protect their benefits better, only can we have perfect legal system. However, there is not very clear provision about the right of employment services to migrant workers or migrant workers employment services organization and its Operating mechanism, there are only Principle-related provisions in Constitution,Labor Law,Employment Promotion Law,Labor Contract Law and so on in our current legal system. This is also one of the important reasons that lead to the feeble in the process of the protection of migrant workers the right to employment services and other related rights and benefits.The writer also hope to contribute to his own little bit of power in order to solve the problem of employment of migrant workers better and more effective in this article. In the text, the author analysis the migrant workers and their employment services briefly; then, analysis the legal regulations of employment services to migrant workers and its lack of status in China's current legal system. At last, the author gives the advices to improve the employment services legal system that is the innovation of this article. To perfect the employment services legal system of migrant workers in China, the author mainly analyzes the improvement of existing laws and regulations, and how to make up for vacancies of China's legislature.
