The Study Of The Protection Of The Insurance Consumer Rights

In our country , the insurance is presenting the booming trend, but, we also should notice a number of problems have arisen, which threatens the protection of the insurance consumers'rights. How to protect the insurance consumers'rights becomes a key question on the long-term growth of the insurance. This article takes the problems of the insurance consumers'rights as the object, discusses on how to build up the system of the protection of the insurance consumers'rights.The subject of the thesis is divided into four parts altogether.The first part explains the basic theories of the consumer rights protection. then related with the particularity in insurance , points out that there are six rights needed to pay attention ,which are the right to know, right to choose,right to fair trading, right to claims, right to redress, and privacy. Finally, analyzes the necessity of the protection of the insurance consumers.The second part analyzes the problems in the protection of insurance consumers in our country, which divided in the two parts, laws and regulations. Firstly, points out the flaws in the insurance law, such as the vague object of the law, the deficiency of the principles of the law, the unspecific legal rules, and the conflict of laws. Secondly, analyzes the current regulations in the insurance sector, especially in protecting the right of the insurance consumers.The third part analyzes the insurance consumer protection systems of the countries all over the world, especially in England and USA, and proposes the reference meaning in our country.The fourth part suggests how to develop the insurance consumers protection system of our country, including perfect the insurance law, establish the legal assisting mechanism, bring in"the reasonable expectations", and strengthen the consumers'education and so on.
