Response to carbon era of monetary economy, China actively comply with international environmental voice, must take the road of low-carbon economy. Therefore, emissions trading system first proposed by the Western countries apply equally to us, and subject to affirmation and development.Marketable pollution permits is an environmental protection economic incentives,it is in recognition of the environmental capacity based on the limited resources,and to pollutant emission control as an indicator. As a new environmental policy, it is important to realize sustainable development of the strategic significance. The introduction of the system in china will involve legal, economic, social and other aspects of coordination, is a complex and systematic project.The United States is more successful practical experience of emissions trading among the countries. The success of its operation in case can be set up in China to provide useful lessons, failures can also attach importance and effectively avoided to our country. As the difference between conditions, construction of China's marketable pollution permits with Chinese characteristics should be considered more:special difficulties of incomplete market economy, confusion in the legal system,the narrow perspective of the original pollution control policies,and pollution dispersion etc. But China's emission trading pilot projects carried out in China has prepared permise and advantage. Continuing to explore the economic environmental policy and national environmental awareness has created favorable conditions for its establishment. In general, the implementation of marketable pollution permits in China is necessary and feasible, design of the system can be integrated through the existing policy shift and improve the environmental legal system,those are useful to the implementation of China's market-oriented environmental policy in the further, and to achive the changing of mode of economic development. we should be the basis of overall control, identified as the legal protection of property rights, as the backing of government supervision, fully implement the concept of market economy. Good policy is not only to design comprehensive, but also reflect the better with the existing policies and systems compatibility, it is also hard to solve this problem in this article.Based on the theory of the marketable pollution permits,this paper combinats the theory and chinese practice, seeking the system and the existing legal framework, policy context can promote each other,and include the market interest and environmental rights as part of system design, so that the implementation of the system in our country can consistent with the interests of all its conditions, really become an effective environmental economic policies.
