The system of real estate pre-sale has promoted the development of our country's real estate market, but it also makes a lot of opportunities that the real estate enterprise violate consumers benefits. In recent years the real estate market can't develop as usual because the contradiction between consumer and real estate enterprise became serious more and more. It is necessary that we should retain the system of real estate pre-sale because the case of our country's real estate market is not good enough. So it is necessary that we should supervise the real estate enterprise in the way of perfecting the forward sale conditions of real estate. The paper has analysis the defects of the forward sale conditions of real estate, and connected the method of Game with it. The author thinks it is a effectively way that establishing a dynamic real estate pre-sale conditions that connecting with real estate enterprise scale.The paper has study the following aspects in this way: (1) Make a qualitative analysis between real estate enterprise scale and the forward sale conditions. First, we establish a game model that can analysis the relations between real estate enterprise scale and the enterprise credit in the theory of Game. Second, we study the relations between the real estate pre-sale conditions and the enterprise credit by the study of real estate pre-sale condition's law essence. Finally, the paper study the relations between real estate enterprise scale and the real estate pre-sale conditions:the more real estate enterprise, the lower real estate pre-sale conditions.(2) Establish a dynamic model that can control the proportion of construction fund by the theory of C-D production function. And the paper make a quantitative analysis between real estate enterprise scale and the proportion of construction fund in the real estate pre-sale condition. Then the author use XI'AN as a example to calculate the model. From the analysis, we find that the proportion of construction fund in the real estate pre-sale condition should be a dynamic value, when real estate apply real estate pre-sale license. And when the real estate enterprise scale is bigger, the proportion of construction fund is lower.(3) The paper perfects the real estate pre-sale condition by establishing the system of the construction fund proportion control, supervising the funds from pre-sale, reinforcing the real estate enterprise responsibility of information disclosure. It hopes that our country's real estate market can develop healthy by the way of perfecting the real estate pre-sale condition.
