Banking, the stability and development of which play an important part in the stability of a country's financial market and economic order, stays at the heart of a country's economic system. In our country, the assets of the banking sector account for more than 80% of the whole financial assets. The growth of economy largely depends on stable operation of the bank, while the stable operation of bank has much effect on the stability of the country and the society. In recent years, banking cases have occurred frequently in our country, its complication and the huge damages caused by these cases are amazing. Therefore, it is necessary to strengthen the prevention and control of our country's banking cases to protect the interests of depositors and the public, maintain the safe and effective operation of the banking system and preserve the economic development and the social stability. Although the CBRC (China Banking Regulatory Commission) has done a lot to strengthen the prevention and control of our country's banking cases since 2005, the effect is not ideal. The main causes includes the serious lag of the system's reformation, the unsound of the legal system's construction, the shortage of the cooperation between banks and judiciary organs, the unsound of the internal control's construction, the lower level of the electronic control technology, the shortage of risk early warning system, the weak consciousness of safeguarding control and the weakness of the system's executive force. To change this situation and contain the occurrence of major banking cases, we should strengthen our preventing system by both internal and external ways. As to the internal prevention and control, we should sound the internal control system, promote the electronic control technology, perfect the risk early warning system, enhance the consciousness of safeguarding control and strengthen the execution force of the prevention and control system. From the aspects of external prevention and control, we should deepen the revolution of the banking system, quicken the construction of the related legal system, and build a platform for the communications between banks and judiciary organs.
