Coal always plays a key role in the Chinese resources structure. China has a massive demand for coal, which has reached a peak about 33 million tons in 2010. With coal mining, the situation of Chinese coal safety takes a turn for the worse and becomes very severe. The death rate caused by coalmine accidents still is at a high level. In the foundation period of The People's Republic of China, government has taken measures to control it. The five coalmine accidents show that it has been out of control. It can be reflected in three aspects:firstly, the regulatory system is running sluggish; furthermore, the policies are not working as expected; lastly, the system is not strict.Therefore, this article takes examples by the policies which American takes, then learn their experience and get some new ideas. Before 1930s, American suffered from period of coalmine accidents happen frequently. America's coal mine safety situation is not optimistic. Annual death toll reaches about 2000 people perennial. What's worse, the death rate has even reached as high as 8.37 in 1907. Thanks to a series of legislation, highly independent supervisory system, new mining technology and safety equipment, the number of deaths has been declined. Nowadays, the coal mining has been safer in America. Nowadays, China has got three enlightenments from America:firstly, the government should be determined and take actions to supervise it. Secondly, build highly independent supervisory system to prevent the formation of benefit league and rent-seeking phenomenon. Thirdly, pay attention to the labor union.Game theory, which was in the process of the government regulations, thinks that the government may be ultimately controlled by the coal enterprises and will eventually lead to "failure" for the influence of potential game goal from the government regulation and the coal mining enterprises gaming Angle. First, the official rating system is Unscientific and imperfect. Second, the different interest demand between central government and local government leads the regulation of the Safety production in coal mine ineffective. Third, regulation legal system is not perfectly. The important reason of regulation "failure" is the ambiguity of power and duties of the regulation subject. Based on the above analysis, this paper puts forward three countermeasures to deal with the coalmine accidents. For one thing, depend on the scientific concept of development to guide coalmine production and promote the growth mode transformation of GDP. Besides, establish and perfect the supervision system of coalmine industry. Finally, we need to pay attention to the law education and the related regulations of training work for coal miners and mine enterprise controller, moreover,strengthen the function of labor union is also very important.
