Study On The Ecological Restoration Deposit System Of Mineral Resources

After the discussion and implementation of mineral resources restoration andmargin management system, very good effect has been obtained and the system hasbeen gradually popularized across China. However, in the concrete implementationprocess, there is a series of problems to be urgently solved. Based on the background,the paper analyzes the current situation of the implementation of mineral resourcesrestoration and margin management system in China and proposes severalcountermeasures of optimizing and constructing China’s mineral resources restorationand margin management system on the basis of referring to the relevant experience ofother countries.Firstly, the paper analyzes the definition, nature and roles of mineral resourcesrestoration and margin, as well as the related theories such as sustainable developmenttheory, public goods theory, externality theory, etc with the formulation of mineralresources restoration and margin. Secondly, the paper analyzes the current situation oflegislation of mineral resources restoration and margin management system and thedeficiencies existing in practice, mainly including unclear right and liabilities as well asdivision of labor, single imposing form, unreasonable margin management system, thelack of public participation and unsound review proceedings. Thirdly, the paper refersmineral resources restoration and margin management system of the United States,Australia and Japan, and puts forward the enlightenment on China’s mineral resourcesrestoration and margin management system, namely, sound laws and regulations,diverse imposing forms, thorough public participation measures and specific reviewproceedings.The main innovation of this article is, puts forward some countermeasures forperfecting the margin system of ecological restoration of mineral resources fromtwo aspects of the connotation and extension of the legal. Legal connotation includes tostrengthen the legislation of mineral resources restoration and margin managementsystem and determine its specific contents and the rights and obligations of alldepartments; to enrich the form of mineral resources restoration and marginmanagement system; small mines can take cash format; large mines can take non-cashformats such as assets and guarantees, and accelerate the introduction of market mechanism; to optimize public participation ways of mineral resources restoration andmargin management system, strictly implement information disclosure system andprotect the rights of public scrutiny; to strengthen the regulation of mineral resourcesrestoration and margin management system, enhance margin funds management andestablish strict rewards and punishment mechanism.
