Migrant Workers in China's social development and the process of the emergence of a special group to promote China's economic growth has made great contributions in the social and economic life play an important role, but they played for the urban modernization, it is also a huge role of the city where most vulnerable groups, the edge of the city, their long-term can not be guaranteed basic rights. Treatment in employment discrimination in essence is also a violation of the right of citizens to equal employment. In this paper, combined analysis of the actual social phenomenon of treatment in employment of migrant workers manifestations of discrimination, from the theoretical level of migrant workers, employment discrimination, employment discrimination, the concept of treatment, and then analyze the causes of discrimination in employment, as well as the negative effects of discrimination in employment, re-the importance of equal employment system configuration. And use comparative study approach, drawing on international and foreign advanced experience of the region on how to improve China's anti-discrimination in employment legislation to provide an effective system of ideas, to curb discrimination in employment, the protection of employment conducive to the attainment of equality of basic human rights of workers, promote social justice building a harmonious society of this paper is divided into six parts:The first part, I first point out that the employment status of migrant workers, and then summed up with cases of the treatment of migrant workers encounter manifestations of discrimination. In general, the treatment of migrant workers suffered discrimination in employment, mainly in wages and working conditions in two ways.The second part, from the concept of analyzing the general principles of, first, the definition of migrant workers, the definition of discrimination start with an analysis of treatment in employment and then to define the concept of discrimination.The third part of the treatment of discrimination in the employment of migrant workers cause analysis, and recommendations draw on the following theoretical basis. The treatment of migrant workers through the employment discrimination analysis to identify the causes of the phenomenon caused by the existence of the historical, institutional, legal, market and migrant workers the five aspects of their own reasons.The fourth section, first analyzes the status quo of China's legislature, because the legal framework of regulations, principled, practical operational weakness, lack of information on rights and obligations, responsibilities and other content of specific provisions. Reconstruction of migrant workers to equal employment system is a necessary requirement for building a harmonious society, the practical needs of economic development.Part V, the main foreign legislation and related systems were introduced to highlight the United Kingdom, the Netherlands, the United States, discrimination in employment situation. And then summarizes the empirical analysis of foreign legislation in the reconstruction of China's migrant workers employment equity system, legislative system of revelation.Part VI, on how to solve the problem of discrimination against the employment of migrant workers put forward countermeasures and suggestions.
