On Environmental Liability Insurance System

Today, the United States,Germany and other countries have already set up effectively environmental liability insurance system.However,the construction of this system in China is still at the exploratory stage.In order to prevent and resolve the serious consequences of environmental pollution and coordinate the interests of all parties as far as possible, in order to timely and effectively solute the environmental tort compensation and maintain the legitimate interests of victims, in order to ensure the needs of social harmony and stability,we need study mature approach abroad,combined with China's national conditions, establish a scientific and rational environmental liability insurance system.This article is divided into three chapters,the key elements are as follows:The first chapter is the introduction part.The part consists of two parts, namely the research background and literature review. After we investigated the empirical data and the seriousness of environmental pollution,we found the environmental liabilityinsurance is imperative;at the same time,reviewing the literature,we can clear insight the current research status of this system.The second chapter is the practical basis of the environmental liability insurance and theoretical analysis.The part is discussed from three aspects,namely the concept and characteristics of the environmental liabilityinsurance, the environmental liabilityinsurance rooted practical needs, theoretical analysis of the environmental liabilityinsurance.After analyzing,we believe the system has a reliable practical basis and solid theoretical basis.The third chapter is about how to build environmental liability insurance system,which is the key part of the article.The part consists of three parts,namely the necessity and feasibility of building the system, the basic principles how to build environmental liability insurance system, the specific ideas how to build environmental liability insurance system. After analyzing,the author proposes four basic principles how to build environmental liability insurance system,at the same time,claiming environmental risk assessment system,the determination of a reasonable premium rate,the determination of insurance liability exemption, the determination of the period of limitation and the development of insurance design of specific system.
