Economics Of Consumer Protection Of The Public Utility Enterprises

The public enterprises are the enterprises who provide society with basic public products and the public service through the internet or other infrastructure (or related in network management),these basic public products and the public service must satisfy the reliability,stability and safety requirements, and meet the social public common demand. The public enterprises include the public utilities that provide water,power,heat,gas,postal service,transportation service,telephone service.The goods and service they supplied are fundamental,quite closely related to peoples daily life. The public enterprises have a large number of customers,so if their products and services have any quality problem impaired comsumers rights, the effects are more serious and far-reaching than we have anticipated. However, there exists damages to consumer-rights ever and again in legal practice because of the defection in legal system,such as the trains and planes always behind schedule,the charge for calls are not correct, the postal have a poor service,these have lashed people into a frenzy of anger.So research the consumer-rights protection in public enterprises by economic means, analyses the reason of the problem and the countermeasure to avoid them,design a better system arrangement, it is of great importance in raising the the well-being of the people and Maintain social stability.By review the study in this field,we found that some of them just refer to the monopolies ruin consumer-rights when they study momopolies,some of them just analysis consumer-rights protection in a particular field,some of them ambiguous discuss consumer-rights protection,no one have special research consumer-rights protection in the public enterprises, this make poor maneuverability, what's more, most of the existing research are leaded by jurists.This paper based on the articularity of public enterprises, using the theory and methods of economics, analyzesd the problems and reasons existing in consumer-rights protection in public enterprises,find a system and put it into effect,which can make up the inadequate of law theory,give the suggestion more maneuverability.The consumer-rights protection in public enterprises is a complex and systematic project,which involving many aspects such as legislation, judicature, law enforcement, and administration. This requires that public enterprises guarantee high efficiency,ensure supply and maintain social stability.So,we must use the scientific method to manage, consider specific interests of different circles. By the analytical method of system theory,the discussion on the Fundamental Concepts of the consumer-rights protection in public enterprises was first carried out,I defined the concept of public enterprise,the essential features of public enterprise,the consumers of public enterprise,the rights of consumers. I find the problems existed in our consumer-rights protection of public enterprises.Then I use the Comparison and analysis method, use the experience of other countries for reference, At last,I through economic analysis,with considering the actual conditions of our country, propose a new system with detailed methods:First of all, set apart administrative supervision and enterprise managerial, introduce market competition, improve the legal system for protecting competition.In the field of in public enterprises control, Standardize Standard Form Contract,choose a appropriate pricing method, perfect price hearing system, establish a perfect information release system for public enterprises.At last,In litigation system,we can establish public interest litigation system in consumer area by rising the claim for damages to consumers, reducing costs of proceedings,expanding the ruling effects,enlarging the ruling scope.
