The economic system of china is experiencing the transformation from planned economy to market economy, Establishing the system of the State-Owned Enterprises( SOE)'s bankruptcy become the most important system- design in this period. China began to establish the system of the SOE's bankruptcy since 1986, 30 thousands SOE have withdrawn from the market。The Chinese system of the SOE' s bankruptcy had experienced the period of investigation,Now in the period of bankruptcy by policy,will step in bankruptcy by law in the future。Because government plays an important role in the bankruptcy of the SOE in china ,it causes a lot of unique phenomenon ,we define it"the bankruptcy of the SOE leading by the government"。This article begins from the behavior of government in the bankruptcy of the SOE,uses modern administrative theories,management theories and economy learns,combines the facts of the bankruptcy of the SOE in ChongQing,gives lots of examples about how the government to do in the course of the bankruptcy of the SOE,analyze the reasons,characteristics and regulations,clarify the bankruptcy of the SOE in the transformation period from planed economy to market economy, point out the negative effect to our economy ,society and legal system about the behavior of the government in the bankruptcy of the SOE .Aim at all the questions and how to transform the behavior of the government in the bankruptcy, this article gives a lot of counter plans .Through the research of these questions will help us correctly comprehend and realize the administrative behavior of the government in the bankruptcy of SOE , point out the changing trend of this administrative behavior. It will also be benefit to the research of the administrative behavior in other fields in the transformation periods of china.
