Collective construction land use rights transfer (short for "CCLURT") is an urgency problem on China's reform of the system of rural land. The distribution system of CCLURT proceeds is an important part of the system of collective construction land use. There are several problems, such as unclear land rights, fail protection of land rights. This paper regards the stock collective construction land as the research object. Based on the Theory of Marxist Rent and the Theory of Land Property Rights, on the consideration of the status quo of the proceeds formation and distribution, we will discuss the problems of the CCLURT proceeds' formation and distribution, and put forward some advices.First, this paper gives the concept of "collective construction land" and "collective construction land transfer", also points to the research object and content. The research object is stock rural collective construction land, including group enterprise land, infrastructure land and public utilities land (except rural house land). The content of research is the formation and distribution of the CLLURT proceeds.The second chapter is about the theory basement of the CLLURT proceeds. First, we use the Theory of Marxist Rent to explain the structure of the CLLUCT proceeds with the consideration that the collective construction land price is composed of different property rights. Different rights compounding shape different prices. The increment caused by the CCLURT not only from state's devotion but also from land purpose's change. In current situation, the land purpose should be regulated by state. We can consider that the state enjoys land development rights which can take the increment.In the third chapter, the CLLURT and its distribution will be discussed. We will interpret the history and status quo of the legal policy on the CCLURT, in conjunction with the pilot city's reform experiences, summed up the problem on the CCLURT, proceeds' formation and distribution.The fourth chapter will tell you how the CCLURT proceeds forms. According to the price mechanism by principle, we plan to establish a market-led mechanism with the Government through the planning, taxation and other indirect measures on regulating the formation of the proceeds.In the fifth chapter, my opinions and advices on the problem will be putted forward. The clue is: guarantee the interests of collective land owners. In the interests of state and land user, the investment in land and profits should be compensated. Every member of the collective economic organization has the rights to enjoy the benefits from CLLURT.
