The basically effective protecting measure for which to get the patent, maintain and protecting in today law protecting system and the arouse method, should be the lasting and the protecting. The essence of patent is one kind of arousing for property right, which make the technical resource with the jural confirmation and clear boundary. The patent system will build up during the real procedure for patent, also, this also can lead to great room to arouse the enterprise ability.As the economy globalization and effected by WTO, we are facing austere challenge. For the time being, some multinationals continually litigate domestic enterprises for the patent tort. However, our domestic enterprises which cover the three features extremely insufficient talent, inefficient management and unsubstantial management function just realized the intellectual patent in recent years. The article will be divided into three parts to state on the issue. The first part about the present situation analysis on patent management of domestic enterprises pointed out nine problems which include the below the existing feeble realization on patent strategy, being short of independent patent and core technology, not being good at using information of intellectual patent, being absent of patent apply assessment system, not being with good quality for the most of patents, etc. Moreover, the article analyzes the factors for existing problems and lists out some suggestion. The second part refers to the advanced management experience of domestic and multinational enterprises. It absorbs good management system of advanced enterprises both from domestic and overseas on the issue of our existing nine problems for patent management , and analyze they how to avoid and solve the above nine problems. What is more, regarding the strategy of applying patent, the second part also introduces parts of opinions from authoritative scholars for imitating. Our analyze and introduction is for improving our patent management capacity and efficiency based on their good management experience. In addition, aimed at the unsolved problems with the experience introduced in the second part, or some special reasons, or based on the need of summarizing, in the last part the author brought forward to set up scientific enterprises patent management system which covers two points. First, it suggests to set up special department, strengthen professional talent training and keep them in the enterprises which is divided into three points to state. Second, based on the need of operation system, it said to set up scientific enterprises patent management system which is divided into four points to discuss.Nowadays, under the situation of adjusting and upgrading where our domestic enterprises experiencing renew liberating thought and deepen the reformation of economy and political system, the patent is especially important. Numerous domestic enterprises now should not miss the invisible asset because of neglect of international regulations and should not miss advanced talent because of lack of management. But should prepare enough knowledge to avoid the tort of intellectual patent and train excellent talent to create favorable intellectual patent.Therefore, our domestic enterprises should learn the successful experience of intellectual patent management from overseas enterprises and absorb the international common abided related legal articles into strategic management so that to improve the technology innovation as well as adjustment and upgrading of economy structure during the process of economy globalization. And then meet the present request to set up perfect enterprises patent management system.
