On The Legal System Of Circular Economy

In the first instance,this thesis carried on detailed demonstration about the necessity,importance,feasibility of the recycled economic theory, developing recycled economy,constructing the legal system of recycled economy. It pointed out that the traditional economy is a materials economy as a single direction flow of "Resources—Consumption—Disposal of pollutants".For the economic growth is set up in high investment,high consumption,high wasting and high foundation that pollute,it obviously will cause the shortage of the natural resources and exhausted,and may lead to the calamitous environmental pollution effect.What recycled economy advocated is a kind of economy that based on the fact that being utilized in material production and process of consumption by circulation constantly new economic development model,and the operational mode of the economic activity is "Resources—Products—Consumption—The regenerated resources",which make the whole economic system and production and process of consumption not basically produce or only produce a small amount of offals.Recycle economy has been created the "3R" criterion,that is,we must carry out a Criterion of "Reduce","Reuse" and "Recycle" in the whole course of economic activity.It is the only way of realizing the sustainable development strategy to develop recycled economy.Three level material circulation of recycled economy are as follows:Material circulation inside enterprises(a small cycle);Circulation between enterprises and enterprises(a medium cycle); Systemic circulation of the social level(a large cycle).The recycled economic law refers to the general names of different laws and regulations and legal origin of the social relationships about adjusting and forming because of circulation economic activity,set up on the basis of ecology of economic development model "The law of source control".The constructed of the legal system of recycled economy has been dissected concretely in this thesis,mainly included economics foundation,political science,sociology foundation and jurisprudence foundation.The foreign developed country has already made a lot of experiences and achievements in legislation of recycled economy,which is worth for us to draw and study.Many countries,like Japan,Germany,U.S.A.and European Union,are based on solving economy and growing at top speed and worsening this contradiction with the ecological environment day by day,through legislating to protect the environment and resources to recycle economy,increase after realizing green GDP. At present,our country has already made Draft of the Recycled Economy Law and the laws and regulations for producing and comprehensive resource utilization in some encouragements related to recycle economy,for instanceclean production promotes the law","save the energy law" and "the solid offal pollute the environment and prevent and cure the law",etc.This thesis has carried on deep understanding about Draft of the Recycled Economy Law.This draft is the basic Law in the legal system of the recycled economy,the legal principle of standardizing the development of recycled economy from national development strategy,planning and decision level systematically,also should make legal norm group to improve the project under the guidance of Basic Law of recycle economy,and Israel Draft of the Recycled Economy Law in order to command formulating the intact recycle economy law system innovation system, in order to substantiate the economic law system.
