Discussion On Peasants' Land Rights

Land rights and interests is the basic rights and interests of peasant. Guided by rental theory of Marxist political economics, based on the fundamental theory that the possession system of product material determine the main body correlation in economic interest,concerninig with the western theory of property right, this thesis analyzes the main body correlation in economic interest during the process of distribution of land rent as well as land policy,the relevant law and institute changes of property right boundary fixing and peasants' land rights and interests defending since reforming and opening from the history view point of materialism.With the fact of peasants' land rights and interests being encroached during the course of urbanization, the thesis discusses the way of realizing land rights and interests on the basis of reinforcing legislation regulations formulating and accelerating land financial market growth of land in rural area ,to improve the binary stucture of property right and realizing the peasants' land rights and interests diversified.The main body of the text contains four chapters : motivation of selecting the topic, theories backing up the writing .current situation analyzing and reform exploring.The first chapter tells the topic background and main research method as well as the related research of the topic home and abroad. The second chapter introduces theories backing up: rental theory in distribution of income of Marxist political economics and back-off theory in land acquisition of western economics. The third chapter indicates the current situation of land distribution of income in our country and analyzes the cause of peasant land rights and interests running off. The fourth chapters presents positive role and deficiency in protecting peasants' land rights and interests by analyzing the current laws frame and tracing the land policy during the past 30 , in order to give feasible suggestions of protecting the peasant land rights and interests countermeasure and looking forward to the "new land policy".
