Study On Several Problems Of Peasants' Land Rights And Interests In China

The peasants work hard and painstakingly protect the land they have owned as the source of living. Therefore, land and the benefits from it are the primarily basic rights and interests. The peasants' fundamental interests can be protected if their rights and interests on land are defended. If any harm is done to that, their fundamental interests are transgressed.At present, the problem of peasants' land rights and interests is more and more outstanding, which have already influenced social stability in urban and rural areas and rural economy to develop seriously. The thesis starts with related theory and policy frame of peasants' land rights and interests have analyzed the current situation and problem and the deep reason Of it in the two aspects of rural land contract and land requisition, so as to propose the strategy and countermeasure of peasants' land rights and interests guarantee. The viewpoint is listed as follows:1. The rural collective land ownership, land contract and management right, land income right and the partial disposal right cannot be guaranteed practically, which become the main question of peasants' land rights and interests be prejudiced.2. The ground of the loss of peasants' land rights and interests lies primarily in the flaw of the property right of collective land, the unreasonable of the present system of land requisition, the difficulty of implementation in the principle of "in term of land contract we does not adjust the contract land", the reversal of government's role and the limit of peasant's own.3. In order to guarantee the peasants' land rights and interests, we must perfect the property system of rural land, reform the system of land requisition, rectify the system of circulation of land contract and management right, orient the government's role, establish a special law institution and advance the development of the farmer co-operation economic organization.
