Research Of The Five Dynasties And The Judicial System

In the period of Five Dynasties the dynastic changesfrequently took place and there had many political upheavals and thewhole society was in a long─term state of war. When each new state ofFive Dynasties was founded it usually made laws and promulgateddecrees in order to prove its legal status.The judicial system of Five Dynasties inherited that of TangDynasty's and on the basis of which it made some innovations, whichcreated a new situation of the legal system of Song Dynasty. In my thesisI make an inquiry into the subject from the following aspects such assuing system, evidence system, judgement system, forcible measures, themanagement of jail and the judicial construction etc.Finally, in my opinion, the judicial system of Five Dynasties canbe summed up as following several characteristics. First, it had strongmilitary color. Secondly, it was in a transitional process and was a greatturning point of Chinese legal system history. Thirdly the quality ofjudicial officials was very low and the judicatue was very dark in FiveDynasties, which is seldom seen in Chinese history.
