This dissertation conducts a relatively comprehensive review and comparison between the capital penalty before Qin Dynasty and that of the Western and the Eastern Han Dynasty on the base of careful study of former achievements. By means of careful study of death penalty in the Western and Eastern Han Dynasty, for instance, the categories of it, the time of execution, substitute penalty, and a series of other issues concerning death penalty, this dissertation intends to have a further look into the features and influences of the death penalty in the Han Dynasty.on the various and cruel ways of execution in Qin Dynasty and pre-Qin period. It discusses t The first part of the dissertation introduces the development of death penalty, with its focus he follows and reforms with regard to the practical aspects of death penalty in the pre-Qin period.With the micro way of study in mind, the second part introduces the practical enforcements of death penalty in the Han Dynasty, including the ways (basic and special) of execution and determination of punishment. The fourth chapter talks about the substitute form of death penalty, i.e. the cases of absolution, atonement for death, and reduction of death, as well as the conditions for these substitutions. When researching the issues on family members of those criminals sentenced to death, this dissertation covers the different punishments to them according to the damage caused by those criminals, which reveals the real punishment imposed on the criminal's relatives by the Han authorities.In the sixth chapter, this dissertation makes a careful study on the sites of execution in Han Dynasty. Supported by many historical materials, "secret execution" did existed in Han Dynasty, which makes up the insufficiency in the previous study of sites of execution in Han Dynasty. Based on the statements in the previous chapters, the seventh chapter makes a conclusion on the features of the day in Han Dynasty, which reveals the gradual process of civilization of the system of death penalty.The last part of the dissertation is a conclusion, and it probes more into the negative and positive influences brought by the death penalty in Han Dynasty. Macroscopically, the dissertation discusses practical influences exerted by the death penalty and its influences to the penalties in the succeeding dynasties.
