The Penalty of Qian and Xi during Qin and Han Dynasties, which combines the banishment of ancient times and the Northern Wei Dynasty, is an important part of the history of the banishment. The biggest difference between the Penalty of Qian and Xi and the Penalty of death, working and fine is to realize the effect of Penalty by the way of space. This paper will analyze the penalty and space, which is the double characteristic of the Penalty of Qian and Xi, to explore the combination and construct the contact of the above.This article mainly begins from the following several aspects:Chapter One makes a tentative study of the Penalty of Qian and Xi during the Warring States Period and the dynasty of Qin and Han from the point of view of the history of law. According to the different characters of different times, this article divides the Penalty of Qian and Xi into three parts:from the Warring States Period to the early Western Han dynasty, the mid and late Western Han dynasty, and Eastern Han dynasty to discuss the application, penalty level and the way of execution of different stages. It is believed that the reform of law arose which influenced all of the Penaltys due to the rapid social changes, leading to the changes of position and effect of Penalty because of the combination of Kun Qian Cheng Dan Chong.Chapter Two deals with the distribution and change of the area of Qian and Xi from the perspective of historical geography, and explores the geographic elements which constitutes the area of Qian and Xi. This part first discusses the distribution and changes of the area of Qian and Xi at various stages from three periods which are Qin, Western Han and Eastern Han Dynasties, finds out the regulation and draws the map of distribution of the area of Qian and Xi. The article then examines the location, transportation, and the natural and human environment by the type of static analysis which influenced the informing of the area of Qian and Xi. It is thought that the area changed fast before the destruction of Qin which lied in the using of the border region to be the area of Qian and Xi. During the Han Dynasty, this area can be divided into two parts according to the identity of the people who were banished:the area of Qian and Xi for feudatory kings focused on Bashu area during the Western Han Dynasty, and transferred to the middle and lower reaches of the Yangtze river because of the rebellion of Qiang people during the Eastern Han Dynasty; the area of Qian and Xi for ordinary people lied in the Hexi area of the North which transferred to the eastern area of the north and the Hepu of the south in Western Han Dynasty which transferred to the region that was more distant lately.Chapter Three discusses the relationship between people's geographical opinion and the Penalty of Qian and Xi. This article observes the influences of geographical opinion respectively from the macro and micro angles. It is thought that the construction of a country had a lot to do with people's geographical concept. From the Warring States Period to the early Western Han Dynasty, the two-element antagonism of the Eastern and Western was the main situation which transferred to the layer structure with the captain to be the center after the Emperor Wu of Han. At the same time the ancient Chinese people who were famous for Loess civilization showed impressive attachment with the earth, and the fear of migration widely existed in people's mind. The Penalty of Qian and Xi was practiced for a long period so that some special emotional imagery arose at the same time.
