Citizen Ethical And Moral Rights

The moral right problem of Citizens in the social development of Chinese citizens is a main content of the current Chinese moral construction. This paper discusses the practical significance and the way to achievement of citizens' moral right construction with civil society as background and on the base of the common value of the civic ethics and moral right, then provides theoretical and practical probe to the construction of the civil moral right. The structure of this paper:The first part: The concepts of civic ethics and moral right. First of all, it sorts out the concepts of citizens and civil society, and then puts forward the viewpoint: the essential of civil society is the legal guarantee of the civil right and the equality of civil personality. On this foundation, the paper analyses the concept and content of the civic ethics, considers that the right basis is the spirit substance of the civic ethics, emphasizes the subjective personal right of the citizen is the core factor of the civic ethics. The next, the paper analyzes that the moral right is a importance part of the right constitution, and mainly review the meaning of the moral right,the logic relation of the moral right and the legal right,the inner relativity of the moral right and the moral duty, and then have the overall understanding to the moral right.The second part: The common value of the civic ethics and the moral right. At this part, emphatically investigates the inner link of the civic ethics and the moral right. With social common body of modern citizen as the foundation, and with modem human rights as the bridge, the citizen ethics and the moral right carry out the common value: The affirmation of the citizen corpus value is the common and worth target of the civic ethics and the moral right, independent personality,free character,equal right,social sense of responsibility and so on are not only the basic content of civic ethics, but also inevitable request of moral right; The right spirit that the moral right contains is the moral foundation of the civic ethics, the independence and equality of the citizen personality that reflect in the moral right not only show the modernity of the right spirit, but also reflect the request of the civic ethics; The worth principle of the civic ethics is a spirit basis for supporting and ensuring the moral right, the right basis spirit of the civic ethics is advantageous to perfect the moral right theories, to solid the groundwork of the moral right, and carry out the citizens' moral construction.The third part: the maintenance of citizens' moral right and growing the civic ethics spirit. The reason is that imperfection of the civil moral right is the moral source of the lack of the civic ethics , but the Chinese civil moral right is under the influence of traditional culture,politics,economic condition etc. , these factors restrict the guarantee and perfection of moral right, and result in the lack of the ethics spirits such as civil independence,participation,contractual type and sense of responsibility etc. Therefore, the construction of the civil moral right needs a kind of soil that is advantageous to the citizen individual right growth and the system guarantee, the civil society naturally becomes the inevitable ways and expectations of the construction of the moral right. The civil society provides the realistic condition for the construction of the civil moral right. Under the big background of the civil society, the consciousness of civil right is the prior condition of the realization of the moral right, the public spirit of citizens is the spirit assurance of the realization of the moral right, and the civil right protection mechanism is to provide the system guarantee for the realization of the moral right. Three organics unify to guarantee the growth of the civic ethics and maintain the moral right all-directionally.
