Lawyer Public Interest Litigation Research

In recent years, with the increasing numbers of public interest litigation, there are a lot of theories about the public interest litigation emerging. As a practicing lawyer for many years, the author also has started to study the theory and practice of the pubic interest litigation. All in all, this kind of litigation relate to not only the maintain of the public interest, but also the construction of the legal system and it is an important part in building the socialist rule of law in our country. And lawyers, as an integral part of the building a socialist rule of law, are playing form a connecting link between the preceding and the following role. In our country, the lack of the public interest litigation laws had a serious impact on the sound development of the public interest litigation.This paper includes five parts. First of all, the author analyses the origin and the significant that the lawyers involved in public interest litigation, emphasized the need for lawyers in the public interest litigation. In this part, the author mainly analyze from such aspects as the source of the litigation, the significance of starting this litigation and the necessity of the lawyer in the litigation. And then, the author take some cases to do studying the current develop situation of the public interest litigation, involving the analysis of the results of these cases and summarize the features of this litigation. After that, the author analyses the obstacles that spans in the lawyers to participation in public interest litigation. After, in response to above obstacle, the author put forward appropriate feasibility proposals.
