Some Thoughts On Improving The Attorney General To Attend The People's Court At The Same Level Committee System

That system of procurator-general attend judicial committee of equal level court is authorized by Constitution of the People's Republic of China, which is very important for legal supervision connect fully with judge. The system exist for more than 50 years since it established, however,which had been still principles for a long time. After several reforms of judicial system, which was confirmed important content of the reforms? Up to now, many problems needed shoveled in practice due to unclear recognition to the system of orientation of law and function, difference opinions to provisions of law, unsoundness of judicial systems and emphasis of criminal judicial supervision but neglect civil and administrative judicial supervision. In January ,2010, the Supreme People's Court and the Supreme People's Procurator ate jointly established< the Practice Principles of Procurator-general Attend Judicial Committee of Equal Level Court > made concensus of recognition and orientation of law of the system is legal supervision.Hence,the function of the system is type of actual effect.In content,compared with the princilples regulation,the Practical Principle added detail regulations.But I think,the the practice principle limited the cases in 3 types of cases,that is,death penalty, Criminal Protest and innocent cases is narrow.No detail explaination of responsibility for Procurator-genenal's attendance brings difficulty in practice.Hence,more details need established in practice.In addition,the legal supervision for the civil and administrative cases need emphasized. The aid systems of inner and outer Procurator ate need established and ect. All of these are powerful securities for practice of the system.
