Copyright Protection Of Digital Works Published

This study starts with the analysis of "copyright battle" of Google Company and some other famous copyright conflicts occurring around the early years 21st century. Based on the case study, the author found some reasons to the copyright conflicts taking place in digital work publishing. Then the author discussed the copyright protection experience in the digital publishing field home and abroad. Meanwhile, the author brought forward some practical suggestions on how to improve the legal system copyright laws of our country. Case studies, literature studies and comparative analysis of related issues had been adopted during the composing process. There are four primary parts in the essay besides "preface" and "conclusion".The first part was the introduction of the copyright conflict Google had encountered around the world when preceding the digital library project, which indicated that the copyright protection system has been challenged, especially in the digital publishing field.In the second part the author clarified the reasons caused copyright discords. First, the notion of digital work publishing has not been clearly defined. Second, the legal relationship of publishing industry has been changed during the digital revolution. And finally, the conflict between the new publishing technique and the traditional balance of copyright system, as the author referred to, is the main causes of the copyright conflicts.The author introduced the some copyright protection experience abroad, which was practical and could be employed at home. In the terms of copy limited, technological protection measures, copyright compensation and Internet service providers, the WIPO, US and the EU all had approved innovations to continually protect the copyright.In the fourth part the author argued the problems and other issues about the copyright protection system in China. In the digital work publishing field we have some achievements, but there's still a long way to go. In order to set a new balance of the rights among the copyright owner, digital work publisher and the public, as well as to protect the spirit of the copyright legislation, we should perfect our Copyright Collective Management System, make appropriate attempts to copyright implied license, and establish our copyright compensation system.
