Domain Name On The Legal Nature Of The Rights And Protection Mode

With the development of science and technology, nowadays Internet has become an integral part of people's lives. The emergence of various types of websites has brought great challenge to the relatively stable and traditional legal system. How to solve the large amount of Internet domain name disputes, and protect the legitimate interests of domain name owners, has become an urgent legal issue.This article adopts the method of comparative analysis. In the beginning of the article, it defines the nature of domain name rights based on the legal property of the domain name rights. Then it analyzes the current typical domain name protection model and proposes the necessity and feasibility of specific legislation for domain name rights. Finally, based on the evaluation and analysis of current domain name protection model in our country, it suggests to legislate specially for domain name protection for the sake of continuous improvement in the legal system in terms of domain name protection. The article is written in three chapters:In the first chapter it analyzes the legal property of the domain name rights. It mainly discusses contents and characteristics of the domain name rights, obstacles in defining the rights as well as necessities in doing so. The purpose is to prove that domain name rights are a new type of civil rights.In ChapterⅡit works on the legal protection models of domain name rights. It mainly discusses the current status of domestic and international legal protection of the domain name rights and the defects in adopting Trademark Law and Anti Unfair Competition Law to protect the Rights as well as the necessity and feasibility of specific legislation for domain name rights.In ChapterⅢit studies on the legal system and its practical application in relation to domain name rights. It mainly elaborated relevant laws and policies with regard to domain name, the legal protecting models in judicial practice, as well as the outlook for specific legislation on domain names in order to improve the domain rights specific legislation.
