| The Tang Dynasty was an important period of China's ancient history, when the custom of respecting the elderly people formed and being promoted. The legal system of of respecting the elderly people which had its own characteristic and efficiency in Tang Dynasty was build up based on the experience which were passed from Xia,Shang,Zhou to Weijin period. Based on a typical period of Tang Dynasty, we will analyze its legal system of of respecting the elderly people deeply, and searching for the system guarantee and legal description of these regulations, to understand the importance and maintenance of the elder men's right by the whole society in the light of the rule of law of the country, and sum up the practice of progressive and age limitations, so that we can further explore these experiences and lessons for the today's social system construction .This paper includes 50,000 words, which is delivered into 4 chapters. In the first chapter we explore the custom of "respecting the elderly" of Chinese people; the second chapter is the key of this paper which involves " treatment of identity","economic concessions","parents privilege",and "judicial protection "four aspects, combined with the historical literature and law of tang dynasty, introducing the system and measures of respecting the aged in that period; in the third chapter, we analyze reasonable value and historical limitations of Tang Dynasty's system of respecting the elderly, searching for the formation of this social progress and deficiencies of these systems; in the fourth chapter the modern enlightenment of Tang Dynasty's legal system of respecting elderly is discussed, summarizing the advantages and background in that period, serving present society. |
