Public opinion is people’s inner tendencies establishing on the basic of the judgment of specific people or issues. In recent years, people are paying more and more attention on criminal trails. Public opinion plays an important role in the hot criminal cases. Sometimes, the judgment of court is different from public’s expectation. Via public’s protest, public opinion influences the judgment sometimes. There are three reasons why public opinion and criminal trail have conflicts. First, the media amplify the incorrect public opinion. Second, people are not satisfied with the social problems reflected by the criminal cases. Third, some judges abuse discretionary power. In order to establish a healthy interaction between criminal judicature and public opinion, criminal trial should be as equitable as possible which including having a good command of the principle of legality, impartial judgment, and judicature independence. Furthermore, according to developed countries’ experience, courts should fully open the information of trails. In addition, it is a good way to accelerate democratic process and improve judicial organs’ reputation by establishing jury as an judicial experiment in some serious criminal cases and enhancing the current juror system at the meantime.
