Research On The Legal System Of Defective Product Recall

"Sagitar car recalls" event in 2004 caused extensive public concern. The system of defect product recall in China has improved a lot since the 21 th century. Meanwhile, recall awareness of the enterprise has strengthened. However, Chinese defective product recall system is in the exploration, and there are still some drawbacks need to be solved. There is no relative legislation in China until 2004. The recall system is clearly stipulated in the 2014 New Consumer Protection Law, which still needs to improve.This paper will start from the "Sagitar car recalls" event to clearly scope relative definitions. Then, the framework of Chinese defective product recall system will be introduced. At the same time, the author will discuss the inadequate legislation and realistic difficulties. The inadequate legislation refers to imperfections of legislative system, ambiguous department division and incomplete matching system. Next, the thesis will describe the defective recall system of advanced countries which can provide reference to China. Last but not least, the author will propose some suggestions to improve Chinese defect product recall system. There is no denying that the continued improvement in recall system and the enterprise’s recall awareness will help a lot on promoting the development of market economy.
