On The Right Of Freedom Of Movement

As one of the basic human rights in modern society, migration freedom is recognized by most countries, and even written in their constitutions. In the 1954 Chinese constitution, the right of migration freedom is regulated, but Chinese citizens have essentially lost the migration freedom since "the household registration ordinance" promulgated in 1958. In all previous constitutional amendments, the right has not been mentioned. Nowadays, the absence of migration freedom in China brings us a lot of social problems. With the deepening of reform and opening up, the reform of migratory system is necessary and imminent.Under the above social background, the author wrote this thesis. First of all, starting from the concept and definition, the essential meaning of the migration freedom right is expounded.Secondly, In order to enlighten the reform on the migration freedom right in our country, the specific safeguard measures of other countries are discussed in detail.Thirdly, by analyzing the defects of migration freedom in our country, the author concludes that the household registration and land system are the biggest barriers that prevent the migration freedom. The basic way to achieve migration freedom is to reform or even abolish the household registration system and to reform land system prudently through measuring the relevant interests.Finally, the author puts forward his suggestions as well as the significance and value of migration freedom in his thesis.
