Freedom Of Migration

The freedom of Migration is the right of citizens to choose their resident on the will in the scope of law. It is an inalienable right for the modern legal country's citizens. As the freedom of migration means very important, it causes that defining its properties will decide the position the right of migration freedom in the constitution, as well as whether it's necessary to control the freedom of Migration. Though there are many different definitions of the migration freedom right in the constitution research, as far as I'm concerned, when analyzing and referring the scholars'ideas, the freedom of Migration should be the equal personal liberty.The right of migration freedom is the expression of citizens'will is the nature right's confirmation on the law is also the right of personal liberty restricted by certain condition. The most constitutions of each country in the world and personal right conventions of international, all of them, make some relevant regulations to the freedom of Migration and carry out confirmation and guarantee. There was also some experience of constitution practice our country history, however, no sooner than new country was founded; the constitution cancelled the recognition of the right of migration freedom for various reasons. As the establishment and development of market economy, the tide of civilian occurs year by year, this causes that the drawbacks of household registration management system are increasingly outstanding. The problem of the migration freedom appeals the common attention. Lots of provinces cities and autonomous region reform the household registration management system to try solving the problem of migration freedom, aiming for fitting the economic development requirement on the way. But the policies of reformation haven't solved the problem of migration freedom radically. The importance of the migration freedom is increasingly outstanding, no matter the need of keeping personal right or the demand of social economic development; both of them require urgently that our country recovers the guarantee of the migration freedom in the constitution. Nowadays our country carries out reformation on all aspects. Which is the basic for realizing migration freedom, our country should include freedom right to the constitution guarantee as soon as possible, according to the history trend.
