Urban mendicancy is a widespread social phenomenon. Countries can only be in the allowed under the premise of the existence of legal regulating them. There are a series of discussion about State of urban begging the specific reasons for the legal regulation and how to regulate urban begging behavior.In this paper, there are four parts about urban begging behavior law regulation problem. In the first part, the author defines the nature of urban mendicancy behavior. Through clarifying the scope of beggars, it should be defined the scope of beggars who should be given the legal regulation. The author will define the behavior of beggars by identifying the relationship between mendicancy and human rights and freedom. The author believes that what we guarantee for the mendicancy behavior is not the "right of mendicancy" but the "right of relief" from the country or the society when people are faced with inhuman living conditions. When the beggars are unable to maintain the basic living standard, they have to survive by mendicancy which is a kind of negative freedom. In the second part, the author mainly elaborate the reasons of legal regulation from three aspects that the nature of mendicancy behavior, the social influence and the experience to treat mendicancy behaviors of various countries. The third part introduce the historical changes of legal regulation of urban mendicancy behaviors. In addition, the author makes a brief introduction to the regulations and laws of mendicancy behaviors of China. It points out the defects of shelter and repatriation system and the imperfect of the rescue management system. In the fourth part, the author put forward the methods to regulate the mendicancy behaviors in the direct and indirect ways to effectively ensure the beggars to get the assistance.
