Since 2000, the Chinese government officially proposed the strategy of "Going out", encouraging and supporting the qualified investors to develop overseas investment. With China’s increasing investment abroad, it promotes the economic development of China and the host country, but along with the increasingly obvious environmental problems which has brought certainly negative impact on their environment. Being a new and flourishing power in investing abroad, China has experienced the process from absorbing foreign investment to investing abroad, which is totally opposite to America who began with exportation of capital and becoming a great power in absorbing foreign investment. Therefore, it is vital for China and America to balance their investment in absorption and exportation. China can’t set foot on repeating the “treatment after pollution” as its concept of environmental protection, but should achieve economic benefits along with protecting the environment of the overseas investment and promoting the sustainable development of the economic environment.As for the trend of investing development nowadays, this article explores, from mother country’s point, the reasons and methods of regulating the investors’ environment behavior. The author firstly analyses the relationship between international investment and environmental protection, as well as the status of China’s overseas investment and the cause of environment problems. With the help of existing academic research results and after reading a large number of related literature, the author analyses in details the necessity and feasibility of protecting the overseas investing environment. And then by combining with the relevant laws and regulations, the legislation of environmental protection on China’s current investment was sincerely analyzed. What’s more, it was proposed that it is better to solve China’s environmental problems caused by investing abroad through improving the domestic legislation and the bilateral investment treaty. By solving the problem as quickly as possible, it not only can reduce the economic loss caused by potential environmentalproblems, but also can maintain China as a responsible country.
