A Study On The Legal Mechanism Of Compulsory Agricultural Insurance In China

Agricultural insurance as a means to spread the agricultural risks, compensate for the loss of agricultural risks, has become the most countries in the world to protect agricultural production, a powerful means of improving social security. China in the development of agriculture, the long-suffering invasion harsh natural disasters,agricultural insurance should be China’s agricultural development and the protection of indispensable system.About agricultural insurance, our laws are currently being established the way by voluntary insurance. Now, despite the rapid development of China’s agricultural insurance, but its prevention and risk diversification function yet effective play, the development is facing some problems. Firstly, are major natural disasters, and high rates inhibit the supply of insurance; secondly, is the absence of agricultural reinsurance and catastrophe risk diversification mechanism weakened agricultural disaster insurance protection function; thirdly, is the desire to buy low purchasing power of farmers and agricultural insurance moral existence risk and adverse selection problem; lastly, the government policy of support for agricultural insurance is not in place, the legal protection system is not perfect.Due to the special nature of agricultural insurance, many countries enact the compulsory legal system of agricultural insurance, take a mandatory or conditional mandatory way to participate in insurance, this way of ginseng can ensure participation, avoid adverse selection, to solved a lot of problems of the agricultural insurance development, our country also should build up a perfect as soon as possible and mandatory agricultural insurance legal system with Chinese characteristics. This article discussed compulsory in our country agricultural insurance law mechanism’s design in detail, the content of the specific include four parts: The first part from the force analysis on the necessity and the rationality of the agricultural insurance, put forward the development force in our country agricultural insurance legal system’s point of view, and define the scope of mandatory agricultural insurance. The secondpart sums up the results of agricultural insurance at present stage in our country,analyzes the current agricultural insurance in our country in facing difficulties in the process of development, highlights the reality for mandatory agricultural insurance legal system in China needs. The third part is the analysis and comparison of the legal system of foreign compulsory agricultural, summarizes the successful experience of foreign compulsory agricultural insurance, to provide the reference for the development of agricultural insurance in China. The fourth part is the key part of the article, from the macroscopic Angle the establishment of the compulsory in our country agricultural insurance legal system in the future are analyzed in focus, from the Angle of the micro force agricultural insurance legislation goal and the legislative principles, management institutions set up and the choice of operation mode, the government’s policy support, mandatory regulation of agricultural insurance in detail,to achieve the use of force in our country agricultural insurance legal mechanism to realize stable agricultural production, increase farmers’ income, promote the long-term goal of agriculture and rural development.
