Study On The Protection Of Rural Women 's Land Rights And Interests

Land is the most basic production and living materials of farmers, compared to men, Rural women have stronger dependence on the land. The situation of the infringement of rural women’s land rights and interests often occurs during the process of rural women married, divorced, widowed.The current laws and policies of China lack supervision and correct of village regulations that are against constitution and law. The current situation of rural women’s land rights and interests infringement improve up even harder because of the conflict and lack of relevant legislative mandates as well as the judicial relief channel not expedite.Land rights and interests infringement not only is the loss of the basic production and living materials or the loss of possibility that one can get other property rights related to the land, but also further weaken the weak position of women, which is not conducive to the implementation of the basic national policy of gender equality.Existing research mostly focused on the perspective of sociology, advocating the equality between men and women, researches from the perspective of legal are not only a small number, and most are not very thorough. So the author will analyze the law of rural women’s land rights and interests from the objective reality and the current relevant laws and regulations, find out legal problems which causes problems and limit to solve them thoroughly, in order to benefit the future legislation. With the development of society and economy, rural women’s role and contribution has been more and more prominent, whether the problem of rural women’s land rights security can be solved determines the enthusiasm of rural women in the agricultural production and the rural women’s status. Safeguarding the rights and interests of rural women’s land benefits the socialist new-village construction and the harmonious development of rural society.In this paper, rural women’s land rights and interests is analyzed and discussed by the method of empirical study, standard analysis and method of sociological study. Through collecting relevant research report and typical cases about the present situation of rural women’s land rights and interests, the author trys to get the whole picture of the implementative situation of relevant laws and regulations that safeguard rural women’s land rights and interests.Analyze the existing relevant laws, regulations and policy about rural women’s land rights and interests, mainly research regulations whose content are conflict to explore legal countermeasures to eliminate the contradictions. The study on rural women’s land rights cannot be purely by legal research, aside from the perspective of sociology because it is not only a legal problem, but also a social problem, legal theory achievements even look perfect they will be difficult to achieve effect because of being away from social practice.The author analyzes the current infringement situation of rural women’s land rights and interests, finds out the cause of it, bases rural women’s land rights and interests protection on that rural women need to live on the original land a guarantee survival for, from the perspective of constitutional human rights to complete the construction of rural women’s land rights and interests protection.
