Study On The Problems Of Rural Women’s Land Rights And Interests Protection

The problem of rural women’s land rights and interests related to rural women’ssurvival, development, through the analysis of relevant survey of nearly one paragraph ofperiod, can be found in the rural areas of our country exists generally rural women’s landrights and interests of different degrees of damage, and with the construction of legalsociety, women in the rural areas has more and more awareness of rights, such as not tosolve this problem, it is bound to cause dispute on land in rural areas increased, causinglocal instability.The first part of this paper describes the concept of land rights, defining the scope ofland rights and interests; secondly discusses the status quo of the protection of land rights,to show the current in the vast rural areas, women’s land rights are infringed facts; finally,the current law on protection of rural women’s land rights and interests, including"women’s rights protection law","rural land contract law","property law" and the relevantjudicial interpretation.In the second part, from the land of infringement on the rights of women and landrights refers to two aspects, female types mainly include agricultural married women,married female non agriculture agriculture, divorced or widowed women, uxorilocal femalefour; type of land rights mainly include: the right to the contracted management of land,land use right, land acquisition compensation distribution rights, and land rights relatedinterests; at the same time, the rural area on the in-depth analysis of rural women’s landrights violations of essential reasons of infringement of rights and interests, find problemsin the legislative, judicial, rural collective organizations and administrative relief way thesefour aspects.The third part of this paper mainly on the protection of rights and interests are perfect,the main improvement in other ways, judicial, legislative protection of the three aspects,the legislation includes the definition of collective economic organization membership,clear women land rights and interests, perfecting the right of contracting of landregistration and management system; judicial including strengthening the judicial review ofthe village, clear land rights disputes the scope of accepting cases, judicial referee position;the other way is mainly including the establishment of administrative relief way protectingthe land rights and interests of women in the land contract dispute arbitration, play the roleof.Through the research on the problems of rural women to protect the rights of land canfurther strengthen the rural women’s rights and interests, realize the stable development ofrural society, the improvement of the legal system of rural land in China is of greatsignificance.
