On The Perfection Of Information Disclosure System Of Trust Plan

Information disclosure of Business trust is a legal obligation, which plays an important role in the protection of the settlers and the beneficiaries. In addition, it is also an important respect of Trust company management structure. So in this paper we research basic theoretical questions of Business trust information disclosure mechanism and analyze the problems that exists in information disclosure 。 In response to the imperfection and disadvantages, some suggestions are provided to complete this mechanism.This paper is composed by three chapters, the first chapter states basic theoretical questions of the Business trust information disclosure, and then discusses the values and function of the Business trust information disclosure, which contains the protection of the rights of the settlers and the beneficiaries, the supervision of trust company on the duties of the trustee, and avoiding the negative influence of rigid payment.The second chapter mainly discusses the status quo of information disclosure of Business trust in China, with the relevant laws and regulations made by regulatory administrations listed, and enumerates how does the trust companies fulfill the obligation of information disclosure currently, and then analyzes the main problems existing in the current information disclosure respectively。The third chapter is mainly about the suggestions on how to solve the problems mentioned above. We suggest to build a diversified Business trust information disclosure mechanism by a unified platform of information disclosure, the supplement of related legal system,internal restraints of trust company and market supervision.
