A Study On The Selection System Of Judges In China

The judge selection system as an important part of deepening the reform of the judicial, for improving the socialist judicial system with Chinese characteristics has very important significance. This paper puts forward the problems and introduces the general research situation of the judge selection system. For the judge selection system in our country, there are some problems, such as lacking of moral evaluation mechanism, low age requirement, low requirements of professional knowledge, low legal professional experience, no unified appointed body, serious, the administrative judge selection, formal preparatory judge training system, lacking of the judge promotion mechanism. Then the paper analyzes the reason of the historical tradition, social reality and the system. By analyzing the necessity and feasibility of the judge selection system, in this paper, the two major legal systems of a comparative study of the judge selection system for the improvement of the system of judge selection provides the reference point of view. On this basis, based on China’s national conditions, from two aspects of judges selected qualification and application specific perfecting measures are put forward. Finally, under the background of judicial reform, the paper puts forward the amendments about “Judges law of the People’s Republic of China” and “Organic law of the People’s court of the People’s Republic of China ”.
