| This note will consider whether, in a media-saturated society, it is possible to preserve a defendant’s right to a fair trial in a high-profile case. It will specifically consider whether the prospective defendant in the Deng Yujiao case could obtain a fair trial after all the media attention the cases have received. I will provide a background of the competing interests surrounding trial publicity and the current standards governing lawyers and other trial participants communication with the media. Finally, in addition to the limits on extrajudicial speech considered in the other sections of this note, I will consider alternative remedies of ensuring a fair trial to defendants involved in high-profile cases. |
