A Study On The Criminal Reconciliation System Of China 's Public Security Organs

In recent years, along with the pace of China’s ruling by law, the legal construction of our country has made great breakthrough. In particular, our current legislation is more scientific and perfect than before. In this environment, citizen’s legal consciousness than in the past, improved a lot, knowingly violate the law or ignorance of the law and crime decreased significantly, with incomplete statistics, in recent years in China’s crime rate to maintain the basic downward trend, but from the judicial organs to provide the data, in recent years, the crime showing reduction of major cases, ordinary small increase. Most of these ordinary cases are mainly composed of disputes or negligence. The subjective malice is not high, the social harmfulness is not obvious, the crime is not obvious, and the whole process of judicial resource is wasted. In this case, the concept and application of criminal reconciliation are introduced into the legal theory circle and judicial practice, which is a kind of legal theory and judicial practice.Legal disputes and legal issues are a trend in our country’s judicial reform. However, due to the lack of participation in criminal cases, the relevant laws and regulations are not perfect, and the lack of public trust in the mediation organizations. In the specific criminal judicial practice, the main force is still dominated by judicial organs. In our country, the public security organ is the first procedure of criminal cases, the first contact with the parties, and in the first time to understand the case, to grasp the original information department, in this stage of criminal reconciliation has a very important significance, but our public security organs of criminal reconciliation system is very imperfect, and even can not say. Firstly, this paper makes an overview of the criminal settlement system, discusses the current situation of the criminal reconciliation system in our country, and finds out the existing problems in our country’s public security organs, and puts forward some suggestions to improve the system.
