Research On The Criminal Reconciliation System Of Public Security Organs

Reconciliation is a new criminal justice concepts and paradigms.Due to shortcomings of the traditional criminal justice increasingly obvious,criminal reconciliation in many countries has been rapid dissemination and practice.The newly revised "People’s Republic of China Criminal Procedure Law" Criminal Reconciliation officially entered the Code of Criminal Procedure.However,the public security organs criminal reconciliation system has not yet standardized,and bring a variety of related issues in practice.In this paper,comparative aspects,summarized and other methods,the concept of public security organs of criminal reconciliation system,significance,research status,problems,etc.to carry out research,and by improving the police criminal reconciliation system concept.In this paper,a total of 4 sections,The first part,through the interpretation of the concept of the criminal settlement,focusing on the concept of criminal reconciliation,function and value function,and to study the feasibility and necessity of the public security organs in criminal cases investigation stage application of criminal reconciliation.Police criminal law aspects of reconciliation are introduced and studied.The second part describes the status of the criminal settlement.First,briefly discusses the theoretical status of research on police criminal reconciliation.After practice,current legislation on police criminal reconciliation introduced,and finally practical cases,existing procedures and the actual situation of police criminal reconciliation introduced.The third part,study the existing police criminal reconciliation existing problems.Will be divided into two aspects of the problems in the legislation,the second is the practice problemsThe fourth part,combining all three studies section,elaborated a comprehensive police criminal reconciliation mechanisms of vision from the start of reconciliation to reach a settlement agreement,in the criminal reconciliation more fitting POLICE judicial practice,the legitimate interests of the greatest degree of protection for victims,taking into account the suspect’s interest demands.
