A Probe Into The Legal Problems In The Law Enforcement Of Police In The Current Social Environment

The current public security circumstance is varied and complex and all kinds of social conflicts intertwine with each other. This law-enforcement environment objectively requires the polices to carry police weapons, especially police guns, when they are on duty, in order to deal with emergencies. In practice, however, many polices reject to equip with guns, reluctant to carry guns or dare not to use guns. During the past two years, the situation regarding police gun use has been slightly improved due to the implementation of relevant special campaigns and the "actively take of responsibilities" by relevant leaders. However, several police gun-related crimes are coming up successfully, such as the shooting of pregnant lady by drunken police in Guangxi province and the Qingan shooting event. These events give rise to widespread disputes in the society on whether police should carry guns and how to use the guns in legal and reasonable manner. As stated in this essay, the key causes behind this problem, out of many others, lie in the low level of current laws or regulations regarding the use of guns, the obscurity of the gun use principles, the absence of specific rules, and the unclear and inconsistent standards for judging legal liabilities of polices who use guns. This essay aims to, from the legal point of view, summarize the crucial problems existing during the current use of guns by Chinese police, analyze the core causes for these problems and propose legislative suggestions.
