On The Perfection Of Local Laws And Regulations

The clean-up of the local laws and regulations is a basic work and vital part of local legislation, as well as the modification and abolishment of law. In practice, the clean-up system still needs to be improved. This essay focuses on the clean-up system of local laws and regulations, introduces the concept and necessity of clean-up of local laws and regulations in China and points out the problems that exist in practice. Based on the analysis of the reasons, the essay proposes the design and specific suggestions of the improvement and enhancement of quality in the clean-up legal system.The essay first introduces the concept, characteristics and functions of the clean-up of local laws and regulations and points out the necessity from the perspectives as follows:the improvement and unity of legal system, the service of the development of economic and social development, the promotion of the legislation and the enhancement of local legislative quality. Secondly, the author introduces the legislative status of legislation concerning with the clean-up of local laws and regulations and several clean-up legal activities, finds the main problems that exist in current clean-up activities, namely, regular clean-up system doesn’t work, the standard of clean-up is too principle to exercise, the lack of public participation, etc. The author also analyzes the reason behind those problems. Finally, based on the above, the author proposes the suggestions on the improvement of clean-up of local laws and regulations, including establish a long-term effective mechanism of regular clean-up and clear standards, improve the public participation during the clean-up process and the effective connection between clean-up system and relative systems, etc.
