With the clean-up of regulations as its main subject, this paper proposes someeffective measures to consummate the implementation of the clean-up of localregulations nationwide by analyzing its necessity and existing problems. This paperholds that clean-up local regulations is a powerful means to deal with such problemsas the conflicts between local regulations and upper laws, the incoherence amonglocal regulations and its unsuitability with local development, thus helping make ourlegal system more scientific and integrate.This paper consists of three parts:The first part gives a general introduction about the clean-up of local regulations,including its concept, characteristics, methods and its necessity. It analyzes thedifferences between the clean-up of local regulation and other concepts concerned;meanwhile, it divides the cleaning up into different types, including advance clean-upand afterward clean-up, centralized clean-up and special clean-up, regular clean-upand random clean-up and etc.. By comparing their respective superiorities andinferiorities, this paper points out the necessity of cleaning up local regulations.The second part focuses on analyzing the defects in cleaning up local regulationsas well as the related reasons. At present, in the job of cleaning up regulations, thereexist such defects: excessive depend on time to time clean-up, unclear clean-upstandard, lack a beneficial interaction between local regulations and related systemsand insufficient public participation.This problems due to such reasons as lack ofmechanism of regular clean-up, lack of uniform cleanup standards, weak awareness ofinitiative clean-up and awareness of public participation is not strong and etc..The third part proposes some effective methods to consummate theimplementation of the clean-up of local regulations nationwide. Considering ourcountry’s current situation, we should make great efforts to establish a long-termeffective mechanism of regular clean-up, establish clear standard, achieve a beneficialinteraction between local regulations and related systems and improve the public participation during the clean-up process so as to guarantee an effective carry-out ofthis work through a variety of mechanisms. |
