On The Improvement Of The Quality Of Local Laws And Regulations

Legislation is an important political activity of the country,the revised legislation law in 2015 and the revised constitution of 2018 have given local legislative power to the districts.Since then,China's local legislation will usher in a new situation.Both central legislation and local legislation are important components of our legal system,it's like the relationship between bones and flesh,both are indispensable.Guided by the principles of central legislation,local legislation complements and improves it.The quality of local legislation is about social development and stability,affecting the vital interests of the broad masses of the people.The way to improve the quality of local legislation and protect the legitimate rights and interests of the people is more and more received attention from the state and the community.In practice,with the increasing number of local regulations,the quality of local legislation has become increasingly fierce and serious.The increase and intensification of local legislation suggested that we should solve the problem and improve the quality of local legislation.The phenomenons of local regulations exists in this paper is that repeating the legislative;homogeneity;lacking of local features;local protectionism and legalization of departmental interests is serious and lacking operability.We use the method of empirical research to analyze the reasons for the low quality of local legislation.It included conceptual deviation of lawmakers;insufficient allocation of legislative resources;the unclear scope of legislative authority;the incomplete legislative process;the low public participation;the unperfect legislative supervision mechanism.And then,we should offer improvement suggestions.Local regulations shall be formulated in accordance with the provisions of laws and regulations,sticking to the direction of the NPC and multiple parties participate in the legislation mechanism,scientific and democratic legislation,efforting to improve the local legislation's characteristics,effectiveness and operability.We will further improve the quality of local legislation.
