Research On Legal Regulation Of Prepaid Membership Card

In recent years, market information technology has developed rapidly.Prepaid card type has become one of the convenient payment method to adapt to the high efficiency economic life. As the carrier of prepaid consumption, the prepaid card simplified the trade and reduces the risk of the deal.It has improved the whole efficiency of economy and society.But we can’t ignore that there does not have a complete system of legal norms and the regulation of the matching to regulating the behavior of both parties. Operators and consumers can’t sign a standard contract in advance.Operator fails in providing the intended goods or services, consumers difficult to protect their rights without avidence.These problems existing in reality are hindering the healthy and stable operation of the market. The purpose of this study is drawing lessons from abroad about the legal regulating of the prepaid card type and laws and regulations in the Taiwan region about gift certificates.And then introduce my own points for prepaid card type legal regulation, and put forward a copy of the prepaid card type contract demonstration text.This paper includes three parts:abstract,body and conclusion, The paper text is divided into four chapters. The main parts are as follows:The first chapter is about the overview of prepaid card.This chapter will be divided into two sections, the first section is an overview,which mainly analysis of the existing theory of the prepaid card,and then put forward the concept of myself. In the second quarter is the characteristics and legal attribute of the prepaid card, the author will analyze the existing theories and put forward my own view in the end.The second chapter research the problems existing in the prepaid card type consumption field,then introduce our prepaid card type consumption in the field of legislation and the judicial present situation.The third chapter is about the legal regulating of the prepaid card type and rules of law in United States and Japan, the study of gift certificates in the Taiwan region,and then put forward content that can use in our country.The fourth chapter is about the perfection of legal system of prepaid card type in China’s mainland. This chapter will suggest setting up a new chapter in the Contract Law, formulate unified national contract demonstration text, increase the operator’s liability for breach of contract,strengthening the management and supervision, setting up the industry association,etc. In the end,I will attach the contract demonstration text wrote by myself.
