A Study On The Legal Protection Of Land - Losing Farmers' Rights And Interests In The Process Of Urbanization

Urbanization is the trend during the development of the country’s social economy.In recent years, by the accelerating urbanization in our country,original urban land can not adapt the demand of land in infrastructure construction and industrial development of urbanization, urban borrowed suburban and rural land has become an inevitable trend, which formed a huge group of land-lost farmers.At present, due to some defects on law and system, the protection of land-lost farmers’rights and interests have not been corresponded in social and economic life, which leads to conflicts and mass incidents, eventually restricts the urbanization process and social harmony. Urbanization is an inevitable and irreversible trend during social development, but maximumly protecting land-lost farmers’rights and interests who sacrificed their interests in the process of urbanization is necessary.This article is divided into five parts to study the protection of land-lost farmers’ rights and interests in the process of urbanization.The first part of preface is mainly about selected topic background and research significance, literature review and research methods of this article.The second part is mainly about defining the concepts involved in this article, analyzing the relationship between cities and land-lost farmers’ rights and interests.The third part analyzes the situation that land-lost farmers’rights and interests defect in the process of urbanization, mainly on two aspects:The rights and interests of material things and the rights and interests of mental health.The fourth part in view of the situation that defection of land-lost farmers’ rights and interests, studies the reasons why land-lost farmers’rights and interests defect, mainly on four aspects:the land system, land expropriation system,land expropriation compensation system and the urban and rural dual structure.The fifth part proposes suggestions to better protect land-lost farmers’rights and interests, mainly on following aspects:Rural land legal system, legal system of land expropriation, land expropriation compensation legal system and social security law system...
