Since the Westernization Movement, China’s vocational education has experienced from scratch, from a single, simple to diversity training mode, training mode conversion system. Along with its own development of vocational education and the continuous evolution of the process of promoting the rule of law, legalization of vocational education has become more perfect and mature. Especially since the reform and opening up, promulgated the "Degree Regulations" as a prelude to legalization of vocational education began to enter the fast track of development. Since then, the country has gradually developed, the enactment of the "Education Law", "Labor Law", "Teachers Law", "Vocational Education Law", "Law on Higher Education," the basic law. With the enactment of the legal relationship adjustment vocational education in special laws, as well as relevant laws to regulate the establishment of vocational education provision, vocational education in China legal system is basically formed.Formation and perfection of the legal system of vocational education, within a period of time to provide a favorable legal environment for the development of vocational education in China, but with varying levels of economic development and the development of advanced models, the development of vocational education itself, vocational education lag legal system is becoming increasingly prominent. As the legal system of vocational education in the special law, "Vocational Education Act" can change over time, vocational education is directly related to the healthy long-term development, but also directly related to the level and the level of the rule of law system of vocational education.American and European countries with regard to development of vocational education class experience, its regulation of vocational education is also far ahead of our country, therefore, in the process of China vocational education law, the reference must be to absorb the experience of these countries. At the same time, in the history of the development of vocational education in our country, many still at issue actually have had practical experience, therefore, must also be a review of the history of the development of China’s legal system of vocational education, and only so is it possible for our country Vocational Education Vocational Education law of the practical problems and provide highly appropriate, feasible and scientific advice.In this paper, the research methodology, a literature analysis, historical analysis, comparative analysis and empirical analysis, first review the legalization vocational education in our country; secondly listed since China’s "Vocational Education Law" achievements and presence question; again, through the introduction of experience in dealing with American and European countries on similar issues; and finally, the experience of Europe and America, by improving the system of vocational education Legalization of recommendations.
