Study On The Problem Of Ecological Land Use

As the main body of the terrestrial ecosystem, the forest support the future of mankind. China is a developing country with the largest population in the world, so the good ecological environment is urgently needed. At present, there is a serious shortage of forest resources in our country, the quality and efficiency of forestry development is not high, paying attention to the ecological value of the forest is becoming more and more important.The point of viewing the ecological problems should start from the rights of civil law, it is necessary to treat the ecological problems with the specific rights of the subject and the object of focus to ecological problems in the final analysis. In this paper, the perspective of civil law for the defects are explained, many aspects, further discussion and the corresponding suggestions are in presentation, and then make the ecological forest right related issues with a scientific theoretical basis. In the end, the forest resources in our country can make full use of its ecological benefits, realize the idea of green development, and lay a solid foundation for the rule of law in the construction of ecological forest.This paper is divided into five parts. In the first part, the question is put forward. This part mainly discusses the research background of the ecological forest right and the foundation of the law construction, and defines the related concepts. The second part is to sort out the current legal system. First of all, the legal system of forest ownership management was sorted out, and then the law and regulation of forest ecological attributes were sorted out. The third part, study of China’s ecological forest protection system. Firstly discusses the understanding of forest values in China’s history, aiming at explaining the good tradition of forest ecological construction in China and our better social foundation; secondly discusses the defects of the relevant legal system of our country forest from five aspects.The fourth part, the study of foreign ecological forest. In the first place, introduces the forest’s protection system in Germany. Firstly this paper introduces the general rules of ecological forest law in Germany; secondly introduces the guiding ideology of ecological forest construction; thirdly introduces the mechanism of ecological compensation; In the second place, it introduces the system of forest ecological protection in Japan.Firstly introduces the Japanese system of forest protection law; secondly introduces the forest ownership and forest classification system;third introduces the Japanese forest ecological consciousness; fourthly, introduces the Japan’s the ecological compensation mechanism. The fifth part, improvement of the relevant issues of forest in China. From the point of view of civil law, introduces the five aspects need to be improved, those are improving the forest resources property rights system,improving the conflict of interest between the main bodies of the forest right, following the rights and obligations, perfecting the compensation mechanism of ecological benefit.
