Study On The Perfection Of Forest Rule Of Law System In China

Forests are not only natural resources for human survival,but also important environmental factors for social and economic development.China's forest resources are generally rich,but the per capita possession is small,and there are outstanding problems such as low resource development efficiency,insufficient protection,and difficult management.Under the background of building "beautiful China" and comprehensively promoting the rule of law,the study of the improvement and development of the forest rule of law system is of great significance for promoting the sustainable fulfillment of forest resources by people's needs for a better life.This article is divided into three chapters on the content system.The first chapter is a theoretical overview of the connotation,extension and significance of the rule of law in the forest.On this basis,it analyzes the current situation of the rule of law in the forest,from the perspective of legislation,law enforcement,justice and law-abiding,and finds the necessity and importance of the topic.The second chapter mainly analyzes the rule of law dilemma of the current rule of law in forests from the perspective of problems.The main manifestations are the lag,formalization and lack of scientificity in legislation;the quality of law enforcement subjects is not high,the division of powers and responsibilities is unclear,and the strength is not enough;the main problems in the judiciary are concentrated in forest planning,forest ecological compensation and forest harvesting.The basic behavior did not form an independent,effective and professional judicial judgment;the law-abiding performance showed that the publicity and education mechanism of the law was not kept up,the social forest awareness of the rule of law was not strong,the forest governance innovation was insufficient,and the lack of pertinence and effectiveness.The third chapter proposes corresponding solutions to the problems existing in the construction of forest law in China.In terms of legislation,China's current "Forest Law" is mainly a forestry law from the perspective of institutional construction and actual functions.In order to adapt to the "mainly shifting from timber production to ecological construction",the "Forest Law" should be transformed into a forest law based on ecological protection;comprehensive enforcement of command + control,overall planning,incentives,etc.Means to increase law enforcement;judicially,the three basic legal acts of forest planning,forest ecological compensation and forest harvesting should be used as the center to exert judicial power;at the same time,publicity and education should be strengthened to form a good rule of law social environment.Under the framework of the comprehensive strategy of governing the country according to law,we will rethink the nature and positioning of the rule of law in forests and realize the fundamental transformation from the "legal system" of forests to the "rule of law" of forests.Integrate the rule of law in forest construction into the rule of law.
