Field Investigation And Study On Marriage Custom Law Of Xinqiao Village In Leishan County Of Southeast Guizhou

The stability of the customary law of ethnic minority decided it is still the most important maintenance of national life order within the means of social control.However,the characteristics of the opposite decided it would be with and affect the conditions of material life and the ideological change of its formation and evolution.Customary law of ethnic minority vicissitude will increasingly highlight the content embodied in good rules of value;on the other hand will gradually eliminated,abandon its specification shallow,trite.The customary law of ethnic minority changes the progress of its content,but there are in the interior of the nation and people cling to the existence of specific patterns of behavior of the common law concept but also makes part of the backward,non rational rule is still in play the role of law norm.Thus,it leads to the problem of how to realize the renewal and development of the minority nationality custom law in the change.Based on the nature and characteristics of customary law of ethnic minority awareness and clear its significance as the research object,the author chooses the customary law of marriage intact,Xinqiao village and in recent years,the change rate is obviously of Leishan County,Southeast of Guizhou Province as the fieldwork site,in order to through the analysis of the typical Miao Village customary law of marriage,how to use the law to overcome the inherent limitations,the change of achieve better development.In the formed on the basis of field investigation in this paper,the completion of Xinqiao village is divided into four parts,namely introduction;Chapter 1:Xinqiao village customary law of marriage;the second chapter:Xinqiao village customary law change;the third chapter:Xinqiao village customary law of marriage and the state law relationship thinking.There is the significance of the topic,the introduction includes research purpose,research methods used by the definition,the basic situation,the research of the customary law,this part is the basis of the following chapters writing;chapter xinqiao marriage customary law is the author of the research content of rules of village marriage customary law description;chapter change Xinqiao village customary law of marriage in the form of the author summarizes four types of change,and on this basis,from three aspects of politics,economy,ideology of national law,the implementation of land policy to change the role change of the marriage law of arranged marriages and the liberation of the traditional marriage concept;the last chapter according to the present situation,change after the xinqiao marriage customary law the author makes the analysis,summarizes the existing protection purposes consistent with national law purpose,and normative content of irrational and lag And need to state law of necessity,and for Xin Qiao marriage customary law in the future development,from the angle of relations and the law of the state,analyzes the law by confirm marriage customary law effectiveness and coordination of two kinds of dispute resolution way of marriage customary law supplement and correction and guidance.
