A Study On The Legal Problems Of Workers' Injury Insurance In Peasant Workers In Guiyang City

During social transformation and urban construction, migrant worker working in cities has become an independent scenery line. With more and more migrant workers swarming into the city, they have become the main body of urban industrial workers. They are doing the dirtiest and most tiresome and dangerous work, but their basic rights cannot be guaranteed. They are the vulnerable group that needs the guarantee of the industrial injury system most, but statistics show that the insured rate of industrial injury among them is the lowest. Currently, Guiyang city is developing rapidly, which leads to more and more migrant workers in the city as well as increasing industrial injury accidents for migrant workers. On February 1, 2014, the Implementation Method of Industrial Injury Insurance in Guiyang was carried out, which first mentioned relevant policies concerning industrial injury insurance of migrant workers. However, there still exist many problems when practicing the method. By studying legislation and enforcement deficiencies, this article goes deep into social investigation, seeks the crux of the problems, analyzes various reasons, and puts forward corresponding countermeasures aiming at the problems existing in migrant worker industrial injury insurance system of Guiyang City, thus hoping to safeguard the legal rights and interests of migrant workers in Guiyang City.This article is divided in five parts:The first part is introduction which introduces the background, significance, research status both in and abroad, research method and content.The second part mainly introduces the research and investigation background of this article, including investigation location, investigation contents and so on, and sorts out the investigation data;The third part mainly introduces the existing problems of migrant worker industrial injury insurance system of Guiyang City reflected by the investigation materials of this article through three aspects, economic problem, social problem and namely legal problem of Guiyang City;Through analyzing the data of investigation and research data, the fourth part analyzes the causes of existing problems of migrant worker industrial injury insurance system of Guiyang City from three perspectives,mainly including migrant workers and employer have no awareness of law,the injury insurance mechanism is not perfect,claims cumbersome procedures,and the government oversight mechanisms are inadequate;The fifth part mainly puts forward rational and effective suggestions for solving the above-mentioned problems in three respects, which are perfecting legislation, enforcing laws strictly, strengthening law popularization.
